September 24, 2013

            The Miner County Board of Commissioners met in regular session September 24, 2013, in the Miner County Courthouse.  Members present:  Don Bowman, Voni Durant, Pat Maroney, Alex Protsch and Roger Wentland.  Absent:  none.  Chairman Wentland called the meeting to order.  The Pledge of Allegiance was recited.

            Motion by Durant, seconded by Protsch and carried to approve the agenda as amended.  The minutes of September 3rd  were approved.

            Commissioners acknowledge receipt of a thank you letter from the City of Carthage for the county’s assistance with the resurfacing of Carthage Main Street.

            The SD Broadband Technology Planning Assessment completed by the SD Bureau of Information and Telecommunications was reviewed by the board.  Possible grant funds may be available to make updates to the current technology within the courthouse.

            Flu vaccine immunizations will be provided through the CHN office to all Miner County employees and volunteer EMTs including Carthage Ambulance volunteers.

         It was moved by Maroney, seconded by Durant, and carried to pass the following resolution.

RESOLUTION 13-23

ADOPTION OF ANNUAL BUDGET FOR MINER COUNTY, SOUTH DAKOTA

            WHEREAS, (7-21-5 through 13) SDCL provides that the Board of County Commissioners shall each year prepare a Provisional Budget of all contemplated expenditures and revenues

of the County and all its institutions and agencies for such fiscal year, and

            WHEREAS, the Board of County Commissioners did prepare a Provisional Budget and cause same to be published by law, and

            WHEREAS, due and legal notice has been given to the meeting of the Board of County Commissioners for the consideration of such Provisional Budget and all changes, eliminations,

and additions that have been made thereto;

            NOW THEREFORE BE IT RESOLVED that such provisional budget as amended

and all its purposes, schedules, appropriations, amounts, estimates, and all matters therein

set forth SHALL BE APPROVED AND ADOPTED AS THE ANNUAL BUDGET OF THE

APPROPRIATION AND EXPENDITURES FOR MINER COUNTY, SOUTH DAKOTA, and

all its institutions and agencies for calendar year beginning January 1, 2014, and ending

December 31, 2014, and the same is hereby approved and adopted by the Board of

County Commissioners of Miner County, South Dakota, this 24th day of September, 2013. 

            The Annual Budget so adopted is available for public inspection during normal business

hours at the office of the county auditor, Miner County, South Dakota.  The

accompanying taxes are levied by Miner County for the year January 1, 2014, through

December 31, 2014.

            Zoning Administrator Tami Severson presented the following plat for consideration.  Motion by Bowman and seconded by Protsch that the following resolution be approved.

RESOLUTION 13-24

            BE IT RESOLVED by the Board of County Commissioners of Miner County, South Dakota, that the plat of LOT 1 OF THE CLOVERLEAF THIRD ADDITION, A SUBDIVISION OF A PART OF TRACT A OF THE CLOVERLEAF FIRST ADDITION IN THE SE ¼ OF SECTION 3, T 108 N, R 56 W OF THE 5TH P.M., MINER COUNTY, SOUTH DAKOTA, which has been submitted for examination pursuant to law, is hereby approved and the County Auditor is hereby authorized and directed to endorse on such plat a copy of this Resolution and certify the same.

            Voting aye:  Maroney, Durant, Protsch, Bowman and Wentland.  Voting nay:  none.  Resolution adopted this 24th day of September, 2013.

            Motion by Durant, seconded by Bowman and carried to enter into executive session (9:35) pursuant to     (SDCL 1-25-2 (1)).  Returned to regular session at 10:12.  Motion by Durant, seconded by Protsch and carried to increase EMT Kelli Smith’s rate of pay from $2048.50/month to $2148.50/month effective October 1. 

            Highway Superintendent Ron Krempges informed the board that he would like to utilize the services of  Clark Engineering as a consultant for the 2016 Miner County Signing Project.  Jeremy Beyer has been hired as a highway employee and began employment on September 23rd.  A rough estimate for the county’s share of assistance with the Clearwater/Shannon Colony/Miner County road agreement was presented at $6,800. 

            Debbie Eggert, Miner County Treasurer informed the board that she had completed tax deed proceedings on a parcel located in Canova Village.

Motion by Bowman, seconded by Durant and carried to declare the following tax deed property as surplus and abate all taxes associated with the parcel: Lot 10, Block 33, Canova Village-OP, Miner County,

South Dakota and to transfer the above mentioned property to the Town of Canova.

            Ulteig engineer Brad Stangohr reviewed several scenarios and costs to improve the parking lot and front entry of the courthouse.  Commissioners will further discuss the proposals at its October 1st meeting.  

The Safety Benefits Loss Control Survey & Anniversary Rating Supplement was reviewed.  The commission recommended changing the liability limit from $1.5 million to $2 million. 

            Motion by Maroney, seconded by Bowman and carried to authorize the auditor to make the following operating transfers as provided for in the 2013 budget from the general fund to emergency management fund $25,798, 911 fund $32,632 and road and bridge fund $300,000.

            Motion by Durant and seconded by Protsch to adopt the following resolution.

RESOLUTION 13-25

WHEREAS, insufficient appropriation was made in the 2013 adopted budget for the following departments to discharge just obligations of said appropriations; and

WHEREAS, SDCL 7-21-32.2 provides that transfers may be made by resolution of the board from the contingency appropriation established pursuant to SDCL 7-21-6.1 to other appropriations;

THEREFORE, BE IT RESOLVED that the appropriation be transferred from contingency as follows:  Auditor $1500.00 and Register of Deeds $1500.00.

Voting aye:  Protsch, Maroney, Bowman, Durant and Wentland.  Voting nay:  none.  

            Resolution approved this 24th day of September, 2013.
