December 30, 2015

            The Miner County Board of Commissioners met in special session, December 30, 2015, in the commissioner’s room of the Miner County Courthouse.  Members present:  Alex Protsch, Garrett Gassman, and Tom Reisch.  Members absent:  Voni Durant and Roger Wentland.  Vice-Chairman Protsch called the meeting to order.  The Pledge of Allegiance was recited.

            It was moved by Gassman, seconded by Reisch and carried to approve the agenda. 

            State’s Attorney Greg Protsch and Kristian Ellendorf, along with the applicant for compromise of a lien, were present.  After discussion concerning the placement of the lien on the individual while he/she was a minor, it was moved by Reisch and seconded by Gassman to approve the following resolution:

RESOLUTION 15-36

            WHEREAS, a Miner County resident has filed an application (15-01) with the County Auditor requesting that the County Commissioners of Miner County, South Dakota, to release the lien in favor of Miner County for providing hospital care for the resident at the time he/she was a minor child;

            AND WHEREAS, Miner County has a poor lien against the resident in the sum of $10,694.55 for hospital care provided;

            AND WHEREAS, it is to the advantage and best interest of Miner County to grant the release of said lien;

            NOW THEREFORE, BE IT RESOLVED by the Miner County Board of Commissioners that the lien be released against the resident which Miner County, South Dakota, now has; and that upon this Resolution becoming effective the Vice-Chairman of the Board of County Commissioners of said Miner County and the County Auditor of said County, are hereby authorized to execute a full release and satisfaction of said poor lien on behalf of said County, and that a record thereof be made as provided by law.
