August 2, 2016

The Miner County Board of Commissioners met in regular session August 2, 2016 in the Miner County Courthouse.  Members present:  Roger Wentland, Tom Reisch, Garrett Gassman, Voni Durant, and Alex Protsch.  Absent:  none.  Chairman Wentland called the meeting to order.  The Pledge of Allegiance was recited.  Motion by Protsch, seconded by Durant and carried to approve the agenda as amended.

The minutes of the July 21st meeting were approved. 

The Auditor’s account with the County Treasurer showed a June 30, 2016 balance of $5,856,483.48 and a July 31, 2016 balance of $5,411,729.74 in all state, county, civil, school, and trust accounts.

Commissioners acknowledge receipt of the following correspondence:  SDPAA & SDML Election Notices; Miner Co Achievement Days Schedule; East Dakota Water Development July 21st Meeting Minutes; Miner Co. Sheriff & 911 May & June Monthly Reports; Emergency Management FEMA meeting notice.

The board reviewed the burn ban that is in place within the unincorporated areas of Miner County.  The commission took no action to remove the ban. 

Protsch gave an update on the most recent ICAP meeting. 

Durant reported that the trailer home associated with the variance hearing held July 19th is on the site associated with the denied variance application.

Ambulance Manager Cora Schwader joined the meeting to review ambulance repairs.  Reisch reported on Prostrollo’s diagnostic reports and suggested to look into additional solutions of lack of power in the 2006 Ford Ambulance. 

Custodian Colleen Arens presented a quote for refinishing the courtroom benches.  The board requested that Colby Tolk attend the next meeting to review the project.

Highway Superintendent Ron Krempges reported on the Dakota Access Pipeline construction, pavement marking project, mowing, gravel hauling and bridge inspections.    Existing bids for a new motor grader will be considered at the August 16th meeting.  

It was moved by Durant, seconded by Gassman and carried to remove the following from capital accumulations and revert back to unreserved undesignated as follows:  2017 Bridge Replacement $60,000.

Motion by Reisch and seconded by Gassman to adopt the following resolution.

RESOLUTION 16-16

WHEREAS, SDCL 7-21-51 allows the board of commissioners to authorize the accumulation of funds for a period longer than one year for capital outlay purposes;

THEREFORE, BE IT RESOLVED that the Miner County Board of Commissioners set forth funds from the General Fund for capital outlay accumulation as follows:  $60,000 for Bridge Replacement in 2018.

Voting aye:  Reisch, Gassman, Wentland, Durant and Protsch.  Voting nay:  none.  Resolution adopted this 2nd day of August 2016.

It was moved by Durant and seconded by Protsch to adopt the following resolution.

RESOLUTION 16-17

WHEREAS, SDCL 7-21-51 allows the board of commissioners to authorize the accumulation of funds for a period longer than one year for capital outlay purposes;

THEREFORE, BE IT RESOLVED that the Miner County Board of Commissioners set forth funds from the Road & Bridge Fund for capital outlay accumulation as follows:  $118,396.56 asphalt overlay in 2020.

Voting aye:  Reisch, Gassman, Wentland, Durant and Protsch.  Voting nay:  none.  Resolution adopted this 2nd day of August 2016.

The capital accumulations for the 2016 asphalt overlay ($600,000) has been reverted back to the unreserved undesignated fund.

Auditor Connor gave an overview of the Federal Overtime Final Rule that will go into effect on December 1, 2016.
