December 29, 2020

The Miner County Board of Commissioners met in special session December 29, 2020 in the Miner County Courthouse.  Members present:  Roger Wentland, Tom Reisch, Garrett Gassman and Alex Protsch.  Absent:  Voni Durant.  The Pledge of Allegiance was recited.  Chairman Wentland called the meeting to order.  It was moved by Protsch, seconded by Gassman and carried to approve the agenda.  Brittany Yanish appeared for Public Comment. She addressed the commission concerning the need for a new courthouse Christmas tree.   The minutes of the December 15th meeting were approved as presented.

It was moved by Protsch and seconded by Reisch to approve the following resolution.

RESOLUTION 20-44

            WHEREAS, insufficient appropriation was made in the 2020 budget for the following departments to discharge just obligation of said appropriation; and

            WHEREAS, SDCL 7-21-32.2 provides that transfers may be made by resolution of the board from the contingency appropriation established pursuant to SDCL 7-21-6.1 to other appropriations;

            THEREFORE, BE IT RESOLVED that the appropriation be transferred from contingency to the following departments:  Court Appointed Attorney $959.14; Veterans’ Services $664.30; Contract Law $21077.46; County Nurse $2187.82; Ag Building $385.05; Emergency Management $4729.03; Domestic Abuse $90. 

Voting aye:  Protsch, Reisch, Gassman and Wentland.  Voting nay:  none.  Resolution approved this 29th day of December 2020.

It was moved by Gassman, seconded by Reisch and carried to authorize the auditor to make the following operating transfers as provided for in the 2020 budget from General Fund to Rd & Bridge Fund $550,000; 911 Fund $10,000; Emergency Management Fund $10,000.

It was moved by Gassman and seconded by Reisch and carried unanimously to revert the capital outlay designations of 2020 Bridge Replacement $50,000 and 2020 Asphalt Overlay $650,000 back to General Fund Balance Unassigned.

It was moved by Protsch, seconded by Gassman and carried unanimously to move from the General Fund Balance Unassigned $2,250,000 to the General Fund Balance Assigned for the 2021 Courthouse renovation project. 

It was moved by Protsch, seconded by Reisch and carried to enter into the 2021 inmate housing agreement with Lake County Sheriff’s Office.

It was moved by Reisch, seconded by Gassman and carried to enter into the 2021 inmate housing agreement with the Charles Mix County Jail.

The board was informed of repairs needed to the 2008 Ford Explorer.  Reisch will look at the vehicle before the board makes a decision on the repairs.

It was moved by Gassman and seconded by Protsch to adopt the following resolution and authorize Chairman Wentland to sign on behalf of the county.

RESOLUTION 20-45

            WHEREAS, Miner County wishes to submit an application for consideration of award for the Bridge Improvement Grant Program:  Structure # 49-069-017, located on the North edge of Carthage and;

            WHEREAS, Miner County certifies that the project is listed in the county’s Five-Year County Highway and Bridge Improvement Plan and;

            WHEREAS, Miner County agrees to pay the 20% match on the Bridge Improvement Grant funds and;

            WHEREAS Miner County hereby authorizes the Bridge Improvement Grant application and any required funding commitments.

            NOW THEREFORE BE IT RESOLVED, that the South Dakota Department of Transportation be and hereby is requested to accept the attached Bridge Improvement Grant application.

            Voting aye:  Protsch, Gassman, Reisch and Wentland.  Voting nay:  none.  Resolution adopted this 29th day of December, 2020.

Questions pertaining to the law enforcement clothing allowance were discussed.  The board instructed the auditor to pay the Galls invoice, utilizing the remaining portion of the deputy’s clothing allowance with the deputy paying the outstanding $15.14.

The board reviewed the estimate from Ultra/Connecting Point for equipment and services that will be needed in the proposed relocation to the River’s Edge Bank during the courthouse renovation project. 

It was moved by Gassman, seconded by Protsch and carried to enter into executive session (SDCL 1-25-2 (1)) at 10:10 a.m. to review letters of interest for the open commission position.  The board returned to open session at 10:40 a.m. It was moved by Reisch and seconded by Protsch to appoint Kathy Faber of Carthage to serve as a Miner County Commissioner until December 31st of 2022.  The position will be up for election in 2022 for a two-year term beginning January 1st of 2023.  Voting aye:  Reisch, Protsch, Gassman and Wentland.  Voting nay:  none.  Motion carried.

Sheriff Eggert addressed the board concerning the law enforcement clothing allowance.  Eggert stated he was satisfied with the way the clothing allowance has been utilized in the past and urged the commission to continue with the allowance.

Having no further business, the meeting adjourned until January 5, 2021.  Dated this 29th day of December, 2020.
