November 15, 2016

 

The Miner County Board of Commissioners met in regular session November 15, 2016 in the Miner County Courthouse.  Members present:  Roger Wentland, Tom Reisch, Garrett Gassman, Voni Durant, and Alex Protsch.  Absent:  none.  Chairman Wentland called the meeting to order.  The Pledge of Allegiance was recited.  Motion by Durant, seconded by Gassman and carried to approve the agenda.

 

            The minutes of the November 1st meeting were approved.

  

            The board acknowledge receipt of the following correspondence:  Miner County Moisture Report; SD Dept of Agriculture – Survey; SD DOT – Approval of Miner County’s 5 Year Highway & Bridge Improvement plan; Hometown Holidays – Support Request; and SD DENR – Shannon Colony Manure Mgt. System Permits & Review.

 

            Cindy Dannenbring of Interlakes Community Action Partnership presented an overview of services provided by the organization.  Those services include weatherization, food pantry, transit program, volunteer income tax assistance program, 60’s Plus Dining Program, housing rehabilitation, school supplies, personal care items, and utility assistance.

A hearing was held to consider the transfer of malt beverage license from Jake’s Corner-Friendly’s Fuel Stop-Winfred to operate outside of a municipality for the 2016-2017 licensing period.  Store manager Lisa Wise attended representing CC&F Retail.  It was moved by Protsch, seconded by Gassman, and carried to approve the transfer of the retail on-off sale malt beverage license application of CC&F Retail, Inc. for Tract A of Bessman’s First Addition NW ¼ Section 12-106-55 Clearwater Township, Miner County, SD.

 

            Commissioner Durant left the meeting.

 

            Highway Superintendent Ron Krempges joined the meeting to review personnel, bridge repairs and other highway matters.  He also submitted the following resolution for consideration.

 

            It was moved by Gassman and seconded by Reisch to adopt the following resolution.

 

RESOLUTION 16-25

 

BRIDGE IMPROVEMENT GRANT PROGRAM RESOLUTION AUTHORIZING SUBMISSION OF APPLICATIONS

 

WHEREAS, Miner County wishes to submit applications for consideration of award for the Bridge Improvement Grant Program:

            STRUCTURE NUMBERS AND LOCATIONS:

49-062-020, West Edge of Carthage, SD over Redstone Creek – FY 2019

49-093-020, 2.3 Miles east of Carthage over Rock Creek – FY 2020

49-160-079, 5.1 Miles North of Howard over West Fork Vermillion River – FY 2021

49-161-080, 5.0 Miles North and 0.1 Miles East of Howard over West Fork Vermillion River – FY 2021

 

And WHEREAS, Miner County certifies that the projects are listed in the county’s Five-Year County Highway and Bridge Improvement Plan*;

And WHEREAS, Miner County agrees to pay the 20% match on the Bridge Improvement Grant funds;

And WHEREAS, Miner County hereby authorizes the Bridge Improvement Grant applications and any required funding commitments.

NOW THEREFORE BE IT RESOLVED that the South Dakota Dept. of Transportation be and hereby is requested to accept the attached Bridge Improvement Grant applications.

            Michael’s Construction, contractor for the Dakota Access Pipeline, presented a check to the highway dept. for compensation of potential repairs of county asphalt roads that may arise after the settling around the bored area.  Krempges informed the commission that the signing project may begin in December in the northwest townships of Miner County.

 

            It was moved by Protsch, seconded by Gassman and carried to enter into executive session at 10:29 for personnel discussions (SDCL 1-25-2 (1)).  Returned to regular session at 10:52

 

            Emergency Management Director Bob Calmus reviewed the changes made to the current Local Emergency Operation Plan (LEOP).  Calmus also informed the board of opportunities for classes for elected officials to obtain the required 402 certification for NIMS compliance.

 

            Director of Equalization Tami Severson presented the following plats for consideration.

 

            It was moved by Reisch and seconded by Protsch to approve the following resolution.

 

RESOLUTION 16-26

 

            BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MINER COUNTY, SOUTH DAKOTA, that the plat of LOT A OF HAGEMANN FIRST ADDITION IN THE NORTH ½ OF THE NW ¼ OF SECTION 24, T 107 N, R 55 W OF THE 5TH P.M., MINER COUNTY, SOUTH DAKOTA, which has been submitted for examination pursuant to law, is hereby approved and the County Auditor is hereby authorized and directed to endorse on such plat a copy of this Resolution and certify the same.

            Voting aye:  Reisch, Protsch, Gassman, and Wentland.  Voting nay:  none.  Resolution adopted this 15th day of November, 2016.

            It was moved by Reisch and seconded by Gassman to approve the following plat with the condition that a letter of assurance agreeing that no building permits may be issued to these lots unless and until they have access to a street or Board of Adjustment approved ingress/egress is filed.

RESOLUTION 16-27

 

            BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MINER COUNTY, SOUTH DAKOTA, that the plat of G.L. ROBY TRACT 1 IN THE SW ¼ OF SECTION 11, T 106 N, R 56 W OF THE 5TH P.M., MINER COUNTY, SOUTH DAKOTA, which has been submitted for examination pursuant to law, is hereby approved and the County Auditor is hereby authorized and directed to endorse on such plat a copy of this Resolution and certify the same.

 

Voting aye:  Reisch, Protsch, Gassman, and Wentland.  Voting nay:  none.  Resolution adopted this 15th day of November, 2016.
